These Terms & Conditions (the “Terms”) govern your access to and use of the websites, services, and offerings operated by Tonos Dance School LLC, also known as Tonos Latin Dance (“Tonos,” “we,” “us,” or “our”).

These Terms apply to all users of the following websites (collectively, the “Sites”):

By accessing or using any of the Sites, registering for or participating in any class, course, private lesson, workshop, event, or online service, you agree to be bound by these Terms, our Privacy Policy, and our Student Waiver, Release & Policies Agreement. If you do not agree, you must not use the Sites or services.

1. ELIGIBILITY

You must be at least 18 years of age to use the Sites or purchase services, or a parent or legal guardian must do so on behalf of a minor. By using the Sites, you represent that you meet this requirement.

2. SERVICES OFFERED

Tonos provides dance instruction, classes, courses, private lessons, workshops, events, social activities, and related services. Services may be offered:

In person
Online or virtually
At third-party venues or facilities

All services are subject to availability and change.

3. STUDENT WAIVER & POLICIES AGREEMENT (CONTROLLING DOCUMENT)

Participation in any physical or online service is subject to our Student Waiver, Release & Policies Agreement (the “Waiver”), which must be accepted during registration.

The Waiver is incorporated into these Terms by reference and contains binding provisions regarding:

Assumption of risk
Release of liability
Health and communicable illness
Cancellation, credits, and no-refund policy
Photo and video use

If there is any conflict between these Terms and the Waiver, the Waiver controls.

4. ASSUMPTION OF RISK & PARTICIPATION NOTICE

Dance, fitness, and movement-based activities involve inherent risks, including physical injury, illness, or other harm. Participation is voluntary.

By using the Sites or participating in services, you acknowledge these risks and understand that full assumption of risk and liability terms are contained in the Waiver you are required to accept prior to participation.

5. SCHEDULING, INSTRUCTORS & MODIFICATIONS

We reserve the right to:

Modify schedules, class formats, locations, or levels
Substitute instructors
Change curricula or delivery methods
Cancel or reschedule services

We are not liable for disruptions caused by weather, venue issues, emergencies, instructor illness, government orders, or technical failures.

6. PRICING, PAYMENTS & AUTHORIZATION

Prices are displayed on the Sites and/or booking platforms. By making a purchase, you authorize Tonos and its third-party payment processors to charge the payment method provided.

We reserve the right to correct pricing errors, refuse transactions, cancel orders, and update prices at any time.

7. CANCELLATION, NO-REFUND & CREDIT POLICY

All private lessons, group classes, courses, workshops, events, and services follow the same cancellation policy unless explicitly stated otherwise in writing by Tonos.

All sales are FINAL
No refunds are issued for any service, class, course, event, workshop, private lesson, or deposit

Cancellation & Credit Rules

Cancellations must be made at least 24 hours in advance to receive a credit
Late cancellations or no-shows result in forfeiture of the service
Missed classes are not refundable
Credits, if offered, are issued solely at Tonos’ discretion
Late arrival may result in lost participation time without compensation

Full and binding terms appear in the Waiver.

8. HEALTH & COMMUNICABLE ILLNESS NOTICE

Participation in group or in-person activities may increase the risk of exposure to communicable illnesses.

By participating, you acknowledge this risk and agree to comply with any health, safety, or venue requirements in effect. The full health waiver is contained in the Waiver accepted at registration.

9. PHOTO & VIDEO USE NOTICE

Classes, events, and activities may be photographed or recorded for promotional, marketing, or educational purposes.

By participating, you acknowledge that your image or likeness may appear in such media. The full photo and video release is contained in the Waiver.

10. ONLINE & VIRTUAL SERVICES

If Tonos offers online or virtual classes, digital content, or streaming services:

Access is provided “as available”
Technical issues may occur
Sharing or redistribution of paid content is prohibited

Online participation is subject to the same policies, waivers, and disclaimers as in-person services.

11. INTELLECTUAL PROPERTY

All content on the Sites—including text, images, videos, logos, branding, choreography, class materials, and digital content—is owned by or licensed to Tonos and protected by intellectual property laws.

Content may be viewed for personal, non-commercial use only. Unauthorized reproduction, distribution, or exploitation is prohibited.

12. USER CONTENT

If you submit content (including reviews, testimonials, photos, videos, or messages), you grant Tonos a royalty-free, perpetual, worldwide license to use, reproduce, modify, and display such content for business and promotional purposes, without compensation.

You represent that you have the right to submit such content.

13. PROHIBITED USE

You agree not to:

Use the Sites for unlawful purposes
Interfere with Site functionality or security
Impersonate others
Upload malicious code
Scrape or collect user data
Use the Sites for unauthorized commercial solicitation

We may restrict or terminate access for violations.

14. FORCE MAJEURE

Tonos is not responsible for delays, cancellations, or service interruptions caused by events beyond reasonable control, including weather, natural disasters, government orders, venue closures, emergencies, or technical failures. Such events do not entitle participants to refunds.

15. DISCLAIMER OF WARRANTIES

The Sites and services are provided “as is” and “as available.” We make no warranties regarding accuracy, reliability, availability, or fitness for a particular purpose.

16. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Tonos shall not be liable for any indirect, incidental, consequential, or special damages arising from use of the Sites, participation in services, online delivery issues, or third-party platforms.

Your sole remedy is to discontinue use.

17. INDEMNIFICATION

You agree to indemnify and hold harmless Tonos Dance School LLC, Tonos Latin Dance, instructors, staff, contractors, and affiliates from any claims arising from your use of the Sites, services, or violation of these Terms.

18. TERMINATION

We may suspend or terminate access to the Sites or services at any time. Provisions relating to liability, intellectual property, and governing law survive termination.

19. GOVERNING LAW & VENUE

These Terms are governed by the laws of the State of Florida. Any dispute shall be resolved exclusively in Hillsborough County, Florida.

20. SEVERABILITY

If any provision is found unenforceable, the remaining provisions remain in full force and effect.

21. CHANGES TO TERMS

We may update these Terms at any time. Updates will be posted on the Sites with a revised “Last Updated” date. Continued use constitutes acceptance.
