STUDENT WAIVER, RELEASE & POLICIES AGREEMENT

PLEASE READ CAREFULLY. THIS IS A LEGALLY BINDING AGREEMENT.

This Student Waiver, Release & Policies Agreement (the “Agreement”) is entered into between Tonos Dance School LLC, also known as Tonos Latin Dance (“Tonos,” “we,” “us,” or “our”), and the undersigned participant (“Participant”).

This Agreement applies to all current and future participation in any class, course, private lesson, workshop, rehearsal, performance, event, social activity, online or virtual service, or any other activity offered, organized, or sponsored by Tonos, whether held in person, online, or at a third-party venue.

By registering for, purchasing, attending, or participating in any Tonos activity, the Participant agrees to all terms below.

1. ASSUMPTION OF RISK

The Participant understands and acknowledges that participation in dance, fitness, movement-based, and related activities involves inherent risks, including but not limited to:

Physical injury (sprains, strains, falls, collisions)
Illness or medical conditions
Exposure to communicable diseases
Property damage
Emotional or psychological stress

The Participant voluntarily chooses to participate and freely, knowingly, and expressly assumes all risks, whether known or unknown, foreseeable or unforeseeable, arising out of or related to participation.

2. RELEASE OF LIABILITY

To the fullest extent permitted by Florida law, the Participant hereby releases, waives, discharges, and holds harmless:

Tonos Dance School LLC
Tonos Latin Dance
Carlos A. Tonos Vega
All instructors, assistants, staff members, and independent contractors
All event hosts, venues, landlords, and facilities used
All agents, representatives, successors, and affiliates from any and all claims, demands, causes of action, damages, losses, costs, or liabilities of any kind, including those arising from negligence, that may arise out of or relate to participation in any Tonos activity, except where prohibited by law.

3. MEDICAL FITNESS & RESPONSIBILITY

The Participant represents and warrants that they:

Are physically and medically able to participate
Have no condition that would make participation unsafe
Have consulted a physician if necessary prior to participating

The Participant agrees to immediately stop participation if pain, injury, dizziness, or discomfort occurs.

Tonos does not provide medical insurance or medical care.

4. HEALTH & COMMUNICABLE ILLNESS WAIVER

The Participant acknowledges that participation in group activities may increase the risk of exposure to communicable illnesses, including but not limited to COVID-19 or similar conditions.

The Participant voluntarily assumes all risks related to illness, infection, or disease and agrees not to hold Tonos liable for any illness contracted before, during, or after participation.

The Participant agrees to comply with all health, safety, and venue-specific requirements in effect at the time of participation.

5. CANCELLATION, NO-REFUND & CREDIT POLICY

All private lessons, group classes, courses, workshops, events, online services, and any other services offered by Tonos follow the same cancellation and credit policy unless explicitly stated otherwise in writing by Tonos.

All sales are FINAL
No refunds are provided for any service, class, course, event, workshop, private lesson, or deposit

Cancellation & Credit Rules

Cancellations must be made at least 24 hours in advance of the scheduled service to receive a credit
Late cancellations or no-shows result in forfeiture of the service
Missed classes or sessions are not refundable
Credits, if offered, are issued solely at Tonos’ discretion
Late arrival may result in lost participation time without compensation

6. ONLINE & VIRTUAL SERVICES

If Tonos offers online or virtual classes, streaming, or digital content:

Access is provided “as available”
Technical issues may occur
Recording, sharing, or redistribution of content is prohibited

Online participation is subject to the same policies, assumptions of risk, and limitations as in-person services.

7. PHOTO & VIDEO RELEASE

The Participant grants Tonos the irrevocable, perpetual, worldwide right to photograph, video record, and otherwise capture the Participant’s image, likeness, voice, and appearance for promotional, marketing, educational, and commercial purposes, in any media format, without compensation.

8. PROPERTY & CONDUCT RESPONSIBILITY

The Participant is fully responsible for:

Their conduct during participation
Any damage caused to facilities, floors, mirrors, equipment, or property

Tonos is not responsible for lost, stolen, or damaged personal items.

9. MINORS

If the Participant is under 18 years of age, this Agreement must be accepted by a parent or legal guardian, who agrees to all terms on behalf of the minor and accepts full responsibility for the minor’s participation.

10. FORCE MAJEURE

Tonos is not responsible for delays, cancellations, or service interruptions caused by events beyond reasonable control, including weather, natural disasters, government orders, venue closures, emergencies, instructor illness, or technical failures. Such events do not entitle the Participant to refunds.

11. GOVERNING LAW & VENUE

This Agreement shall be governed by the laws of the State of Florida.
Any dispute shall be resolved exclusively in Hillsborough County, Florida.

12. ELECTRONIC SIGNATURE & CONSENT

The Participant agrees that checking a box, typing their name, initialing, or completing registration electronically constitutes a legal signature, equivalent to a handwritten signature, and confirms intent to be legally bound by this Agreement.

13. ACKNOWLEDGEMENT & CERTIFICATION

By registering for or participating in any Tonos activity, I certify that:

I am at least 18 years of age, or I am the parent or legal guardian of the participating minor
I have read, understood, and voluntarily agree to this Agreement
I understand that this Agreement is legally binding
I understand that I am waiving certain legal rights
